How we handle your data

Introduction

PINK TACO LLC (“PT,” “we,” “our,” or “us”) takes your privacy very seriously. Please carefully read this Privacy Policy and familiarize yourself with our privacy practices regarding your personal information and how we will use it. This Privacy Policy applies to the our website, including mobile websites or apps, all food venues, employment-related information, and any other locations where we collect your Personal Information (collectively, the “Sites”). By visiting the Sites or providing your Personal Information to us, you accept this Privacy Policy. If you do not agree with these policies, do not use the Sites.

For purposes of this Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. It does not include de-identified or aggregate information, or public information lawfully available from governmental records.

Personal Information We Collect

We may collect your Personal Information at various points when you visit the Sites, request information about our products or services, click through links on our Site, or when you voluntarily provided information to us, such as through our web portal, email or phone number.. We may collect Personal Information such as:

  • Personal Identifiers: Name, birthdate, email address, mailing address, and phone number, and other similar information.
  • Protected class information: Age, military or veteran status. 
  • Financial information: payment card information.
  • Commercial Information: records of purchases
  • Geolocation information: Your specific location
  • Educational information: Information about your educational history, degrees and credentials. 
  • Internet or other electronic network activity information:  Device and browser type, browsing and search history on our Sites, and information regarding interaction with our Sites and our advertisements.
  • Audio and visual information: video of you captured on CCTV security cameras installed in our stores.
  • Inferences drawn from any of the information identified above.

If you are interested in career opportunities with PT, you can visit the careers page and learn about open positions. In order to apply for an open position, you will be asked to register. You will be asked to provide your name, email address, and phone number, and to set up a password for future access.

Uses of Personal Information

Your Personal Information may be used in several ways:

  • To process, validate and verify your requests for products or services;
  • To alert you to new projects, Sites features, special events and services;
  • To conduct surveys to measure your satisfaction with our service;
  • To process payment for products or services that you have requested, either directly or through our third party services providers;
  • To monitor and evaluate our Sites and identify where we should make changes or expand services;
  • To improve our Site design and product assortments, provide customer service, and offer special promotions;
  • For advertisers, which receive aggregate – never individual – information about our customer base and usage patterns;
  • To assist our marketing and development staff with developing new features and services that meet customer needs;

  • To protect our rights or property or our safety, our members, or others;

We require that these outside companies agree to keep confidential all information we share with them and to use the information only to perform their obligations in our agreements with them.

Market Research

We may contract with a market-research firm to conduct occasional online surveys. When you’re within our Sites, you may see a pop-up window offering you the optional opportunity of participating in a survey. If you do not wish to participate, simply click the “No, Thank You” link and you will not see this window again. If you choose to participate, you’ll be prompted to answer a series of online questions. You will be prompted to enter your e-mail address for validation purposes. In some cases, you may be offered a free gift for your participation. We will need your name and address, which will be used exclusively to fulfill your gift request.

Cookie Technology

We also employ cookie technology to help subscribers move faster through our Sites. When you use one of our Sites, we pass several cookies to your computer. A cookie is a string of information that’s sent by a website and stored on your hard drive or temporarily in your computer’s memory. This avoids the potentially time-consuming task of checking our registration database each time a page is requested. The cookie is deleted when a user chooses the log out feature to terminate their session. We also employ cookie technology to store subscribers’ usernames and passwords. Do Not Track

Some web browsers may transmit “Do Not Track” signals to websites visited by the user. At this time, our Sites do not respond to browsers’ do not track signals. Our information collection and disclosure practices will continue to apply as described in this policy, regardless of any “Do Not Track” signals that are sent by certain browsers.

Third Party Web Sites

We use third-party advertising companies to serve ads when you visit our Sites. These companies may use information (not including your name, address email address or telephone number) about your visits to our and other websites in order to provide advertisements about goods and services of interest to you.

Our Sites may contain links to websites provided by third parties. Please be aware that we do not control these third-party websites or any of the content contained on those websites. Once you have left our Sites, we are not responsible for the privacy practices of such other websites. We encourage you to exercise caution and to read the privacy policy for the website you visit. The inclusion of hyperlinks to third party websites on our Sites in no way constitutes an endorsement by us of such websites’ content, actions or policies.

International Visitors

We store and process your data in the United States, and we intend our services only to be used in the United States. If you are located in a foreign jurisdiction and do not want to transfer your data to the United States, please do not use our services.

Security

We are committed to maintaining your confidence and trust, and takes steps to help protect the personal information you provide to us. However, no transmission or electronic storage of information is guaranteed to be secure. We therefore urge you to always use caution when transmitting information over the Internet.

Children

The Sites are not directed toward children under 18 years of age nor do we knowingly collect information from children under 18. If you are under 18, please do not use the Sites or submit any personally identifiable information to us.

California “Shine the Light”

California’s “Shine The Light” law permits California residents to annually request and obtain information free of charge about what personal information is disclosed to third parties for direct marketing purposes in the preceding calendar year. California Privacy Rights

If you are a California resident, you have the following rights in relation to your Personal Information subject to certain legal limitations.

Right of Access. You have the right to access your personal information maintained by us. Upon receipt of a verifiable request to access personal information, we will disclose and deliver, free of charge, the personal information requested. To that end, you can ask us for the following types of information regarding the Personal Information that we have collected about you in the 12 months prior to our receipt of your request:

  • Specific pieces of Personal Information we have collected about you;
  • Categories of Personal Information we have collected about you;
  • Categories of sources from which such Personal Information was collected;
  • Categories of Personal Information that the business sold or disclosed for a business purpose about the consumer;
  • Categories of third parties to whom the Personal Information was sold or disclosed for a business purpose; and
  • The business or commercial purpose for collecting or selling your Personal Information.

Right of Deletion. You have the right to request that we delete any personal information about you which we have collected from you, except where the law authorizes us to retain specific information; where the use of the Personal Information is reasonably necessary to fulfil our business practices; to complete a transaction; to provide requested-for goods/services; to perform a contract between you and us; to detect and respond to security incidents and potential fraud; to comply with a legal obligation; and to enable our internal uses that are aligned with your expectations and your relationship with us. Upon receipt of a verifiable request for deletion, we will delete your personal information from our records and direct any service providers to delete your personal information from our records, within 45 days.

No Sale of Personal Information. We have not sold personal information to third parties for a business or commercial purpose in the last 12 months. We do not intend to sell personal information to third parties.

As noted above, we do not knowingly collect information from or about children, including children aged 13 and under. We do not knowingly sell information of minors under 16 years of age.

No Discrimination. We will not discriminate against a California resident because the California resident exercised any of the rights described here. If you exercise your rights under this Policy , you will not be denied or charged different prices or rates for goods or services, or provided a different level or quality of goods or services than others.

Exercising Your Rights and How We Will Respond.

To exercise any of the rights above, or to ask a question, contact us at the contact details set out at the end of this Policy.

For requests for access or deletion, we will first acknowledge receipt of your request within 10 business days of receipt of your request.  We provide a substantive response to your request as soon as we can, generally within 45 days from when we receive your request, although we may be allowed to take longer to process your request under certain circumstances.  If we expect your request is going to take us longer than normal to fulfill, we will let you know.

We usually act on requests and provide information free of charge, but we may charge a reasonable fee to cover our administrative costs of providing the information in certain situations.  In some cases, the law may allow us to refuse to act on certain requests.  When this is the case, we will endeavor to provide you with an explanation as to why.

Verification of Identity – Access or Deletion Requests. We will ask you for identifying information and attempt to match it to information that we maintain about you. We will verify that you are who you say you are by asking you to confirm certain unique pieces of information relating to your relationship and/or transactions with us. If we are unable to verify your identity with the degree of certainty required, we will not be able to respond to your request. We will notify you to explain the basis of the denial.

Ensuring Veracity of Opt-Out Requests. If we have a good-faith, reasonable belief that a request to opt-out of the sale of Personal Information is fraudulent, we may deny the request. Should this occur, we will inform you and explain why we believe the request is fraudulent.

Authorized Agents. You may designate an agent to submit requests on your behalf. The agent must be a natural person or a business entity that is registered with the California Secretary of State.

If you would like to designate an agent to act on your behalf, you and the agent will be required to provide us with proof of the agent’s identity and proof that you gave the agent signed permission to submit a request on your behalf. Additionally, you will be required to verify your identity by providing us with certain Personal Information as described above or provide us with written confirmation that you have authorized the agent to act on your behalf.

Please note that this subsection does not apply when an agent is authorized to act on your behalf pursuant to a valid power of attorney. Any such requests will be processed in accordance with California law pertaining to powers of attorney.

Requests for Household Information. There may be some types of Personal Information that can be associated with a household (a group of people living together in a single dwelling). Requests for access or deletion of household Personal Information must be made by each member of the household. We will verify the identity of each member of the household using the verification criteria explained above and will also verify that each household member is currently a member of the household.

Changes and Updates

We may revise this Privacy Policy from time to time. We will post any changes on this page and update the date at the top, so be sure to check back periodically to stay aware of any modifications. Your continued use of the Sites after changes have been posted will constitute your acceptance of this Privacy Policy and any changes.
